Welcome to Aquaviva!
Thank you for visiting Aquaviva's website. We provide turnkey hospitality and property management services to property owners (“Clients”) and renters (“Guests”), through third-party platforms or directly through our site.
By using our services, you agree to these terms and conditions, along with any additional policies or rules we provide, forming a legally binding agreement between you (the "User") and Aquaviva.
Please read carefully before using our services.
1. Service Overview
- For Guests: Aquaviva manages properties on behalf of Clients. You can make reservations through third-party platforms or directly through our service. Your booking gives you temporary access to the property, but no ownership or tenant rights.
- **For Clients:** The services provided to you include information on Aquaviva's property management services. A separate agreement is needed to become a Client of Aquaviva.
2. Eligibility
You must be at least 18 years old to use Aquaviva’s services. By agreeing to these terms, you confirm that you meet this requirement and comply with all relevant laws.
3. Account Registration
You may need to register an account to use our services, providing accurate and up-to-date information.
4. Identification and Background Checks
For security purposes, we may request government-issued ID or perform background checks before allowing access to properties. If the ID doesn’t match the payment method, we may refuse the booking.
5. Reservations
Reservations provide you with temporary access to a property for a specific period. This access is subject to confirmation and full payment. No automatic right to extend or renew is provided.
6. Fees and Payments
- Fees: Aquaviva reserves the right to change pricing at any time before you complete your booking.
- Currency: Prices are in Mexican pesos (MXN). Exchange rates may affect the final amount if you're paying from outside Mexico.
- Payment Due:Full payment is required 7 days before the start of your reservation.
- Cancellation: Free cancellation is allowed up to 7 days before the reservation. Refunds may incur a small processing fee.
7. Electronic Communication
By using our services, you consent to receive electronic communications from Aquaviva, such as emails or SMS messages.
8. Responsibilities
You are responsible for any damages to the property during your stay. Aquaviva reserves the right to charge your payment method for the cost of any damages.
9. Prohibited Conduct
You agree not to use the service or property for illegal purposes or violate any laws. Misuse, fraud, or damage to the property will lead to termination of your access.
10. Safety Features
Properties may include safety features like smoke detectors or security cameras in common areas. Tampering with these features is prohibited.
11. Termination
Aquaviva may terminate your access to services or properties for violation of these terms without prior notice.
12. Liability
Aquaviva is not liable for indirect, incidental, or special damages, including loss of profits or personal injury, arising from the use of our services.
13. Governing Law
These terms are governed by the laws of Mexico.
